Terms & Conditions

By applying to join the Orchard Thieves Creator Marketplace (“the Marketplace” or the “campaign”), you agree to the following Terms & Conditions. Please read them carefully before submitting your application. By entering the application process, you will be deemed to have read and agreed to these terms and conditions.

The promoter of the Marketplace is Heineken Ireland Limited, Ladyswell Brewery, Leitrim Street, Cork, Ireland ("Orchard Thieves", "we", "us") and is administered with support from THINKHOUSE, acting as our creative and promotional partner.

1. Eligibility

1.1 Applicants must be 25 years of age or older at the time of application.

1.2 To be eligible for paid alcohol-related work, applicants must:

● Be 25 years of age or older, and

● Have an audience where at least 80% of followers are aged 18+, in line with alcohol advertising regulations.

1.3 Applicants must be resident in Ireland, unless otherwise specified.

1.4 Orchard Thieves reserves the right to request proof of age and audience demographics at any stage of the process.

1.5 Applications on behalf of another person will not be accepted, and joint submissions are not allowed.

1.6 The Promoter will not accept any applications that are: (2) automatically generated by computer; (b) completed by third parties in bulk; (c) illegible or have been altered, reconstituted, forged or tampered with; (d) not originals; or (e) incomplete.

1.7 Use of a false name, address or supply of inaccurate information will eliminate you from selection process.

2. Application Process

2.1 Submitting an application does not guarantee selection or paid work.

2.2 All applications will be reviewed by THINKHOUSE on behalf of Orchard Thieves based on brand fit, creative quality, audience suitability and compliance requirements.

2.3 Orchard Thieves may accept, decline or remove applicants from the Marketplace at its sole discretion, at any time and without obligation to provide a reason.

2.4 The opening date for applications will be the X day of X 2026 and the closing date will be the X day of X 2026. No further applications will be accepted after this closing date.

3. Joining the Fox Pack

3.1 Successful applicants may be invited to join the Orchard Thieves Creator Marketplace, also known as “The Fox Pack.”

3.2 Being part of the Fox Pack:

● Does not constitute an employment relationship

● Does not guarantee ongoing or minimum levels of work

● Allows creators to be considered for future briefs and opportunities

3.3 Creators may be removed from the Marketplace if they no longer meet eligibility, compliance or brand suitability requirements.

4. Content & Conduct Standards

4.1 Creators must ensure that all content:

● Complies with Irish alcohol advertising regulations, including ASAI, CCI, IARD and platform-specific guidelines

● Promotes responsible drinking

● Does not appeal to or target minors

● Avoids controversial, offensive or harmful content

4.2 Creators must not:

● Encourage excessive or irresponsible alcohol consumption

● Appear intoxicated or under the influence

● Associate Orchard Thieves with unsafe, illegal or inappropriate behaviour

4.3 Orchard Thieves reserves the right to request the removal of any content that breaches these standards.

5. Creative Submissions

5.1 As part of the application process, creators may be asked to submit examples of previous work or creative concepts.

5.2 By submitting content as part of the application, creators confirm that:

● They own the content or have permission to share it

● It does not infringe on third-party rights

5.3 Submitted application materials will not be used for paid advertising without further agreement.

6. Paid Opportunities & Contracts

6.1 Paid collaborations will be agreed on a case-by-case basis and subject to a separate written contract.

6.2 Each contract will outline:

● Deliverables

Timelines

● Payment terms

Usage rights

Disclosure and compliance requirement

6.3 Payment will only be made once contracted deliverables are completed, approved and compliant.

7. Intellectual Property

7.1 Creators retain ownership of their original content unless otherwise agreed in writing.

7.2 Usage rights granted to Orchard Thieves will be clearly defined in individual contracts.

7.3 Creators must ensure they have rights to all elements used in their content, including music, footage and third-party appearances.

8. Data Protection

8.1 The personal data provided by you in the context of this application process will be processed by the Promoter in accordance with our privacy policy available on heinekenireland.ie/privacy-policy. The details you provide to the Promoter will be stored by the Promoter in order to be able to appoint successful applicants, and may be disclosed to third parties for the purpose of executing the campaign. You can request Heineken® at any time to provide access to the personal data it has collected about you. You can request Heineken® at any time to correct or to delete such personal data. You can send requests for access, correction or removal for your personal data to privacy@heineken.ie.

8.2 Application data may be stored to assess suitability for future opportunities within the Marketplace.

9. Termination & Withdrawal

9.1 Creators may withdraw their application or request removal from the Marketplace at any time.

9.2 Orchard Thieves reserves the right to suspend or terminate participation where:

● These Terms & Conditions are breached

● Regulatory or compliance issues arise

● Brand safety concerns are identified

10. General

10.1 Orchard Thieves reserves the right to amend these Terms & Conditions at any time.

10.2 The Creator Marketplace may be modified, paused or discontinued without prior notice.

10.3 These Terms & Conditions are governed by the laws of Ireland.
